Terms, privacy & compliance

The basis on which we sell, how we handle your information, and what we do about the obligations that come with trading high-value goods.

Terms of sale

Applicable to all offers, quotations and sales by Ariana Precious Stones unless separately agreed in writing. We contract with businesses and institutions, not with consumers.

1. The company

Ariana Precious Stones is a company registered in Dubai, United Arab Emirates. Registration particulars are given in writing to counterparties on request and are not published here. Contact: info@arianapreciousstones.com.

2. Offers and availability

Stones listed on this website are shown as a representative selection. All stones are offered subject to prior sale and subject to confirmation of availability. Descriptions, weights and measurements published on this website are given in good faith and are confirmed definitively on the pro-forma invoice for each transaction.

3. Description, origin and treatment

We state species, variety, weight, dimensions, geographic origin and treatment status — which is none — for every stone we sell, in writing, on the invoice. Where an independent laboratory report exists it is supplied with the stone or made available before delivery.

Origin statements reflect our own sourcing records and, where available, an independent laboratory opinion. Buyers should note that geographic origin determination for coloured stones is a matter of expert opinion rather than exact measurement, and laboratories may reasonably differ.

Goods supplied by Ariana Precious Stones are not treated. No heat, oiling, resin or fracture filling, diffusion, irradiation or dyeing is applied to any material we sell, and every invoice states this. Buyers are free to verify it at any recognised laboratory of their choosing, before payment where that matters to them.

4. Prices, currency and payment

Prices are quoted per carat, per stone and per lot, in the currency agreed, exclusive of tax unless stated. Delivery and insurance are itemised separately. Payment is made against a pro-forma invoice; the routes we accept are set out under Compliance. Goods remain the property of Ariana Precious Stones until payment has been received in full.

5. Delivery, title and risk

Goods are not shipped by carrier. Delivery is made by hand: a representative of Ariana Precious Stones travels with the goods and hands them over in person at the address agreed with the buyer, insured for the whole journey. The point at which risk passes is stated on the invoice for each delivery. Delivery timescales given are estimates; where a delay is caused by customs, travel restrictions or circumstances beyond our control, we will inform you promptly.

6. Inspection, returns and memo

Buyers should inspect goods on receipt and notify us of any discrepancy without delay. Where a stone is found not to correspond to its written description, we will accept its return in unaltered condition and refund or replace it.

Consumers purchasing at a distance within the European Union have statutory rights of withdrawal and conformity which are not affected or limited by these terms. Nothing in these terms excludes liability that cannot lawfully be excluded.

Goods supplied to trade clients on memo remain our property throughout, are held at the client's risk, and must be returned in unaltered condition by the agreed date.

7. Limitation of liability

Save in respect of liability that cannot lawfully be limited — including death or personal injury caused by negligence, fraud, and consumers' statutory rights — our liability in connection with any sale is limited to the invoiced value of the goods concerned.

8. Governing law

These terms and any sale made under them are governed by the law of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of the competent court in [COURT / DISTRICT], without prejudice to any mandatory jurisdiction available to consumers.

Privacy notice

How Ariana Precious Stones handles personal data, under the EU General Data Protection Regulation.

Who is responsible

Ariana Precious Stones is the controller for personal data collected through this website. Write to info@arianapreciousstones.com with any question about your data or to exercise the rights set out below.

What we collect, and why

Enquiry details. When you write to us, we receive your name, company, email address, telephone number if you give one, country and whatever you put in your message. We use this solely to answer your enquiry and to carry out any transaction that follows. The lawful basis is our legitimate interest in responding to people who contact us, and, once you buy, performance of a contract.

Transaction and compliance records. If we trade with you, we keep the records that UAE tax, customs and anti-money-laundering law requires us to keep, including identification documents where those are required of us. The lawful basis is compliance with a legal obligation.

Website usage. This site sets no advertising or tracking cookies.

Who else sees it

Our email provider and web host process data on our behalf under contract. Travel and insurance details are shared with the insurer for the delivery concerned. Where the law requires it, information is shared with tax, customs or supervisory authorities. We do not sell personal data, and we do not add anyone to a mailing list without asking first.

How long we keep it

Enquiries that do not lead to a transaction are kept for [RETENTION PERIOD] and then deleted. Transaction and compliance records are kept for the period required by Dutch law.

Your rights

You may ask us for a copy of your data, ask us to correct or delete it, object to or restrict our use of it, and ask for it in portable form. Where we rely on consent, you may withdraw it at any time. You also have the right to complain to the Dutch data protection authority, the Autoriteit Persoonsgegevens.

Compliance statement

What we do about the obligations that come with dealing in high-value goods.

Counterparty due diligence

We carry out identification and verification checks on counterparties in line with our obligations as a dealer in high-value goods under the applicable Dutch and EU anti-money-laundering framework. New trade clients are asked for company registration and identification documents before an account is opened. We decline business where we cannot satisfy ourselves as to the counterparty or the source of funds.

Source of goods

We buy from known producers and suppliers with whom we have an established working relationship, and we record the origin of material before it leaves the province in which it was produced. We do not buy anonymous parcels of unestablished origin.

Export and customs

Goods are exported from the country of origin under proper declaration and imported into the destination market under that market’s own rules; where it is the European Union, the entry is handled by an established importer of record. Customs, export and provenance documentation is issued as a matter of course and is available to buyers and their advisers.

Sanctions

We screen counterparties, and the beneficial owners behind them, against the applicable EU, UN and other international sanctions lists. We do not deal with designated persons or entities, and we will not transact where a restriction applies.

Payments

We accept bank transfer, cash, major cryptocurrency and, by prior agreement, other instruments; in rare cases we will trade in kind against material. Every route is subject to the same customer due diligence and source-of-funds checks, and we do not accept payment from third parties unconnected to the transaction.

Disclosure

Species, variety, geographic origin and the absence of treatment are stated in writing on every invoice, in accordance with international trade disclosure practice. Where our own view and a laboratory's differ on origin, we will tell you both.
